Goes over administering SNTs in detail. Good explanation of the mechanisms related to SSI, SSDI, and Medicaid, and how they interact with the SNT. Oriented to Massachusetts law, where the authors are, although should be similar in other states since law is federal with state "twists". Has a list of "do nots" and "watch out for" items that is useful, although the list is spread out through the book, would be useful to have an appendix summarizing them. Has a chapter on web site references to go to for more info. Finally, the tax section I thought was a bit vague, as it didn't distinguish between distributions that are return of corpus vs. return of income, and didn't make some other things clear. Overall, however, a good reference.
This is a very useful, much-needed book on a very esoteric topic. The authors have done a great job of trying to simplify for the layman what is a very complex regulatory structure underlying special needs trusts and their administration. However, the most significant benefit to me was that the book indirectly referred me to an expert on elder law and disability law matters in the Massachusetts environment, namely, one of the authors, Barbara Jackins, who in turn referred me to a truly outstanding geriatric and psychiatric case worker in the Boston area, Nancy Seigal of InfoChoice. Together, they have provided invaluable assistance in resolving an extremely difficult situation. Not only would I strongly recommend the book, but I would even more strongly recommend Barbara Jackins and Nancy Seigal. I don't think you will be disappointed.
I bought this book knowing that it was written by trust experts based in Massachusetts, but I was unprepared for the extent to which it focuses on issues specific to that state. I think the authors could have kept that information and broadened coverage of other states. I was also disappointed to find fairly thin treatment of very complicated tax matters regarding trusts, Medicaid, and SSI, and of trustees' obligations to file financial reports to state human resources and finance departments. I thought this would be a more comprehensive source for people overseeing special-needs trusts, but it turns out I need to look at other handbooks.
A useful guide. Not too complex, not too simplistic.
I bought this book because I am considering setting-up a Special Needs Trust for my adult daughter who is disabled. It contains excellent advice on admistering a trust, including what is allowed by law, what is not, and the gray areas. It gave me a much better understanding of how the trusts work and enabled me to have a more intelligent discussion with a trust attorney during our first meeting.
Very informative.
I was not sure what being a trustee of this type meant. This book shows me what I can and can not do for my son. I even took it to court with me to show the judge that I was taking my role seriously. The lawyers all asked for the name of the book so they could pass it on to their other clients.
Is a well written book but like anything with the passage of time, it needs to be updated. The basics are there and are helpfull.Thanks.
